1       Acceptance of Terms and Conditions

www.dragonexpress.com is owned and operated by Dragon Express Gourmet Food Ltd. These Terms and Conditions shall apply to all contracts entered into by Dragon Express Gourmet Food Ltd, a company registered in England and Wales with company number: 09433474 and whose registered address is 26-28 West Street,Bridport,Dorset.DT6 3QP. The company VAT Registration Number is GB254428012. 

Please read this agreement carefully. This represents our Terms and Conditions for using our site; where you do not agree to these Terms and Conditions in full, you do not have permission to access the contents of this website and should cease using it immediately.

We, at our sole discretion, may choose to change the terms, conditions and operation of this website at any time. By using this service, the user waives any rights or claims it may have against Dragon Express Gourmet Food Ltd.

2       Definitions

In these conditions unless the context otherwise requires:

  • "Company", "we" or "us" means Dragon Express Gourmet Food Ltd
  • "Buyer", "you" means the person, or company buying the goods from the Company.
  • "Goods/Products and/or services" mean the products and/or services being purchased by the Buyer from the Company.
  • "Contract" means the contract between the Company and the Buyer for the purchase of the goods.
  • "Date of the contract" means where the order been placed and payments been approved.
  • "Contract price" means the price of goods as agreed between the Buyer and the Company.

Copyright, trademark and other intellectual property laws protect all content, where applicable. By using this site, you agree not to reproduce, re-transmit, distribute, disseminate, sell, publish, broadcast or circulate the content received through this Site to anyone without the Company's express prior written consent.

4       Limitation of Liability

By using this Site, you expressly agree that use of the www.dragonexpress.com web site is at your sole risk. We cannot guarantee use of site will be uninterrupted or error-free and will not be held liable in any way.

5       Order Process & Acceptance

When you place an order through our Service, an email thanking you for your order and confirming your order has been received and accepted by the company. Please ensure that you have given us a correct email address as this is how we will communicate with you about your Order. Please also ensure that you provide an accurate address and telephone number to ensure that your Meals arrive to the correct location. If you do not open the door or respond to telephonic correspondence within 10 minutes of our delivery drivers physically reaching your address, we reserve the right to leave the premises, and you will be charged for the Meal. Company seeks to provide a quality service and will be the first contact in event in there is a problem with your Meal either in regards to food quality and/or temperature. We do monitor our delivery team very closely and it is of utmost importance to us that they comply with our standards and help us to maintain our reputation. Please let us know if you have any comments relating to our delivery team or in respect of the Meals by emailing or calling us.If any instruction is received by the Company from the Buyer for the supply of products and/or services, it shall constitute acceptance of the terms and conditions contained herein. Upon acceptance of these terms and conditions by the Buyer, the terms and conditions are definitive and binding.

Your statutory rights shall remain unaffected by these Terms and Conditions.

6. AVAILABILITY AND DELIVERY

Our aim is to provide the best delivery service possible. Unfortunately things do not always go to plan and factors, such as traffic conditions and weather, may occasionally prevent us from achieving our targets in this regard. We will do our best to ensure that your Meal is delivered by the time specified in the email and webpage. The timing of your order is determined by taking into account the number of orders and the circumstances at that time.

7. CANCELLATION

You have the right to cancel an order within a reasonable time and before the order becomes a Started Order. Company may cancel any order and will tell you once we cancel an order. You will not be charged for any orders cancelled in accordance with this clause. Any payment made prior to an order being cancelled by company will usually be reimbursed using the same method you used to pay for your order. Any order cancelled after it becomes a Started Order will be charged to you. Company alone will determine whether an order is a Started Order or not.

8. PRICE AND PAYMENT

The price of any food and drinks will be listed on our Service. Prices include VAT. Payment for all Meals can be made by credit or debit card through our Service. Once your order has been confirmed your credit or debit card will have been authorised and the amount marked for payment. Payment is made directly to company .

9. EVENTS OUTSIDE OUR CONTROL

No party shall be liable to the other for any delay or non-performance of its obligations under this Agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion. For the avoidance of doubt, nothing in clause 11 shall excuse the Customer from any payment obligations under this Agreement.

10.ALLERGY

11. WAIVER

Neither you nor the Company shall be responsible to the others for any delay or non-performance of its obligations under this agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion.

12. SEVERABILITY

If any provision of this agreement is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced.

13. ENTIRE AGREEMENT

These terms contain the whole agreement between the parties relating to its subject matter and supersede all prior agreements, arrangements and understandings between the parties relating to that subject matter.

14. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

Company may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.

15. LAW AND JURISDICTION

The English courts will have jurisdiction over any claim arising from, or related to, any use of our Services. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

The Company reserves the right to implement a surcharge for alterations to specifications of products after the order has been placed

All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered (plus delivery where applicable).

16   Returns

1.    Please note that all food and beverage items are non-refundable and non-returnable.

2.    If your goods are faulty, please ensure you have photographic evidence as proof and email oxford@dragonexpress.com or contact us phone:01865 761155 with your name, order number and photo detailing faults. Once received, we will include with your refund.

17   Termination of Registration

If you no longer wish to have a registered account, you may terminate your account by sending an email to oxford@dragonexpress.com. If you no longer accept these terms and conditions, or any future modification to these terms and conditions, you must cease using the www.dragonexpress.com

The Company reserves the right to terminate your access to the Site, without any advance notice.

19   Errors on Our Site

Prices, descriptions, image displays, colors, and availability of products and services are subject to change without notice. www.dragonexpress.com  will endeavor to make the Site as accurate as possible, but understands there may be some errors www. dragonexpress.com reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and payment made. If you have paid for your purchase and your order is cancelled, www.dragonexpress.com will refund the amount charged.

20   Governing Law

English law governs the validity of these terms and conditions and of any other agreement reached between www.dragonexpress.com and any of our customers. Any dispute shall be determined by the English courts.

21   Dispute Resolution

The Company will endeavour to resolve any dispute between the Buyer and itself without the need for Court proceedings. Any such attempt is without legal prejudice.

22 Changes to This Agreement

The Company reserves the right to modify these Terms of Service at any time. We do so by posting and drawing attention to the updated terms on the Site. Your decision to continue to visit and make use of the Site after such changes have been made constitutes your formal acceptance of the new Terms of Service.

Therefore, we ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use or continue to access this website immediately.
